Attorney Nick Wheeler has joined the Law Office of Tracey Rosswurm.

Nick Wheeler is a lifelong Hoosier and has made serving his community a top priority.  He earned an undergraduate degree in English from IPFW and then went on to earn his Juris Doctorate from the Indiana University Robert H. McKinney School of Law.  He served for 10 years in the United States Air Force where he deployed 3 times, including a combat deployment as a gun truck commander and M2 Machine Gunner for over 180 combat convoy missions to bases and outposts all over Northern Iraq.    

He is a jury trial-tested criminal defense attorney and a tough domestic litigator who has represented hundreds of clients in Allen, Huntington, DeKalb, Noble, LaGrange, Steuben, Grant, Wabash, Wells, Adams, Kosciusko, and Elkhart Counties.

Criminal Defense

Nick Wheeler has represented hundreds of Defendants in Felony and Misdemeanor cases.  He has won jury trials and dismissals.  He has taught Constitutional Law and is an expert on the 4th Amendment protections against unlawful searches and seizures.  He has represented Defendants in cases that include OWI, Conversion, Maintaining and Visiting a Common Nuisance, Theft, Battery, Domestic Battery, Disorderly Conduct, Public Intoxication, Battery by Means of a Deadly Weapon, Battery Resulting in Serious Bodily Injury, Drug/Synthetic Dealing and Possession, Unlawful Possession of a Firearm along with many other types of criminal charges.

Nick also represents Defendants on probation and parole revocations.

Family Law and Domestic Litigation

Family dynamics have evolved in recent history and half of all marriages end in divorce.  Divorce is, therefore, a large part of the legal landscape.  Nick has the experience to ensure that your marriage is dissolved as quickly and inexpensive as possible.

Issues of Child Custody, Child Support, Visitation and Parenting Time can be very difficult to navigate and an experienced domestic litigator who is willing to protect and preserve your assets and parenting time can make all the difference.

Expungement of Criminal records

We understand that the consequences of a criminal arrest or conviction can have serious ramifications for years after the sentence is served.  We understand how difficult it can be to gain employment or a promotion with criminal convictions on your record. 

Indiana law allows people convicted of misdemeanors and felonies to expunge their criminal record and to make their criminal history invisible in background checks and criminal history searches. 

However, the expungement law is complex and, if filed improperly, a petition to expunge your criminal record may be denied and you may lose the opportunity to clear your criminal record.  If you have criminal convictions or arrests that you want to expunge from your record, Nick has the experience to ensure that your expungement is filed correctly and granted as quickly as possible.  

Grandparent's rights

Indiana law recognizes that a Child's relationship with his/her Grandparents is an important relationship and has carved out a niche in the law to provide certain protections for Grandparents.  If you believe that you are being unreasonably excluded from your grandchild's life, Nick may be able to help.

Juvenile Justice

Nick has three children with the eldest currently attending Manchester University.  He understands that teenagers make mistakes and that no matter how well they are raised, they are one mistake away from entering the Juvenile Justice System.  Even though these are juvenile cases, they are not to be taken lightly. 

A juvenile conviction can have a serious impact on a child's future.  A juvenile conviction can prevent a person from attending college, joining the military, or sitting for the bar exam or for acquiring other professional licenses.  


Nick's wife is an experienced Gestational Surrogate and her experiences with the court system in Indiana was one factor that inspired Nick to attend law school.  

People have heard that surrogacy is illegal in Indiana, but this is not true.  There is nothing unlawful about surrogacy under Indiana law.  There is, however, a public policy statement released by the Indiana General Assembly that renders portions of a surrogacy contract void and unenforceable.  This does not make surrogacy impossible or illegal in Indiana, but it does make necessary an attorney that is competent in this area of law.  

Nick has done much research into this area, in fact, her wrote his doctorate thesis on Surrogacy Law in Indiana.  He is as much an expert in this area as anyone in Northeastern Indiana and he can provide exceptional legal representation in all stages of a surrogacy journey.
